Assumption of Risk Agreement
NOTICE: SKIERS AND SNOWBOARDERS, INCLUDING TERRAIN PARK USERS, AND ALL LIFT PASSENGERS, are governed by the New York State General Obligations Law, Article 18 and 12 NYCRR Part 54 “Safety In Skiing” code, and the Olympic Authority’s policies for the safe use of all winter venues.
New York Law requires that you seek out, read/review, and understand the code’s “Warning to Skiers” before participating in the sports of skiing or snowboarding. In accordance with the requirements of the Safety in Skiing code, the following “Warning to Skiers” code is prominently displayed at the base of all Olympic Authority lifts:
WARNING TO SKIERS/SNOWBOARDERS: Downhill skiing and snowboarding, like many other sports, contains inherent risks including, but not limited to the risk of personal injury, including catastrophic injury, or death, or property damage, which may be caused by variations in terrain or weather conditions; or, surface or subsurface snow, ice, bare spots or areas of thin cover, moguls, ruts, bumps; or other persons using the facilities; or, rocks, forest growth, debris, branches, trees, roots, stumps; or, other natural objects or manmade objects that are incidental to the provision or maintenance of a ski facility in New York State. New York law imposes a duty on you to become apprised of, and understand, the risks inherent in the sport of skiing or snowboarding, which are set forth in this subdivision, so that you may make an informed decision of whether to participate in skiing or snowboarding notwithstanding the risks. New York law also imposes additional duties upon you, to which you must adhere, for the purpose of avoiding injury caused by any of the risks inherent in skiing or snowboarding. If you are not willing to assume all of these risks and abide by all of these duties, you must not participate in skiing or snowboarding at this ski area.
ACKNOWLEDGMENT: I have read and understand the NOTICE and WARNING TO SKIERS/SNOWBOARDERS printed above. In signing this Season Pass Agreement, and using the Season Pass, I signify that I and/or my child/dependent are aware of and understand the risks inherent in the sports of skiing and snowboarding, and that I and/or my child/dependent are accountable for our actions as set forth in the WARNING TO SKIERS code, and all applicable Olympic Authority safe skiing/snowboarding policies designed to support the obligations in the code, as referenced in the NOTICE. I agree that this acknowledgement shall be effective for the entire term of the Season Pass, and that if I and/or my child/dependent fail to adhere to the Safety in Skiing code, or the Olympic Authority safe skiing policies designed to support the obligations in the code, the Olympic Authority has the right to restrict or terminate Season Pass. In that event, I agree that I relinquish my right to a refund of any part of the purchase price.
