Assumption of Risk Agreement

IN CONSIDERATION of the license granted to me by the New York State Olympic Regional Development Authority (“Olympic Authority") to access the Facilities and participate in the Activity described herein, I, the undersigned, expressly acknowledge and agree as follows:
1. Definitions: (1) the “Activity” means the Gore Mountain Car Show, which I participate in; (2) the “Vehicle” means the automobile and/or motorcycle that I am exhibiting at the Activity; and (3) the “Facilities” means Gore Mountain Ski Resort and the location at which I participate in the Activity.
2. PARTICIPATION IN THE ACTIVITY AND USE OF THE FACILITIES INVOLVE INHERENT RISKS THAT CAN RESULT IN SERIOUS PERSONAL INJURY, PROPERTY DAMAGE, OR EVEN DEATH.
3. I knowingly assume all risks of personal injury (including death), and/or property damage, that I may suffer that are inherent to my participation in the Activity and use of the Facilities. I further acknowledge that I am participating in the Activity and using the Facilities at my own risk, and that the Olympic Authority, the State of New York, the Department of Environmental Conservation, and any of their respective officers, agents, and employees, bear no responsibility or liability for any injury, damage, or loss to person or property arising out of or resulting from risks that are inherent to my participation in the Activity and use of the Facilities.
4. I understand that outdoor parking facilities have inherent risks including, but not limited to, the risk of personal injury, including catastrophic injury or death, falls, muscle tears, strains, sprains, fractures, broken bones, head injuries, or property damage, which may be caused by variations in the parking surface or weather conditions; or other persons using the Facilities; or other natural objects or manmade objects that are incidental to the provision or maintenance of a parking facility.
5. I understand and agree that the Olympic Authority does not warrant the safety or security of my Vehicle while at the Facilities for the Activity.
6. I understand and agree that by participating in the Activity, I am not entrusting my Vehicle to the Olympic Authority for safekeeping, and that this agreement does not create an obligation or a legal duty (such as a bailment) on the part of the Olympic Authority to secure and safeguard my Vehicle while it is at the Facilities for the Activity.
7. I understand and agree that the Olympic Authority is not responsible for any damage to my Vehicle (including damage caused by criminal activity) that occurs as a result of my participation in the Activity.
8. I understand and agree that the Olympic Authority is not responsible for any loss of my Vehicle (including loss caused by criminal activity such as theft) that occurs as a result of my participation in the Activity.
9. I understand and agree that the Olympic Authority is not liable for personal injury, illness, or any other condition or effect (including an injury, illness, condition, or effect that is caused by criminal activity) that results directly or indirectly from my participation in the Activity.
10. I understand and agree that the Olympic Authority does not provide insurance to cover damage to or loss of my Vehicle, or to cover medical expenses for injuries, illness, or any other condition or effect I may sustain as a result of my participation in the Activity, and that the Olympic Authority strongly recommends that I carry my own health, medical, and property insurance.
11. I will not participate in the Activity or use the Facilities while under the influence of alcohol and/or drugs.
12. I agree to observe, read, and abide by any and all notices as may be posted at the Facilities which may pertain to my responsibilities as a participant in the Activity and use of the Facilities.
13. If I am signing as a parent or legal guardian for a child/dependent under the age of 18, I represent that I am authorized to sign on behalf of said child/dependent and acknowledge that said child/dependent is bound by all the terms of this agreement. I affirm that I have spoken with the child/dependent about the risks inherent in the Activity that such minor child/dependent is participating in, and I expressly agree to assume the responsibility for making such minor child/dependent aware of such inherent risks.
I UNDERSTAND THAT THIS IS A CONTRACT THAT IS BINDING UPON ME, MY HEIRS AND LEGAL REPRESENTATIVES AND I, THE UNDERSIGNED, HAVE READ, UNDERSTAND AND AGREE WITH THE TERMS OF THIS AGREEMENT
